Pada tahun 2017, kelayanan ahli Parlimen Australia yang mempunyai atau berkemungkinan mempunyai dua kerakyatan untuk duduk dalam Parlimen Australia telah dipersoalkan yang menjadi krisis perlembagaan [1] atau krisis kerakyatan.[2] Isu ini dibangkitkan dari seksyen 44 Perlembagaan Australia yang termasuk subseksyen yang melarang pelantikan kuasa asing dalam Parlimen Australia. Atas dasar itu, Mahkamah Tinggi Australia sebelum ini berpendapat bahawa seseorang yang memegang dua kerakyatan adalah tidak layak untuk dipilih.[3]

Tujuh kes ahli politik yang mendakwa bahawa mereka tidak menyedari memegang dua kerakyatan sebelum mereka dipilih telah dirujuk ke Mahkamah Tinggi Australia oleh kawasan Parlimen di mana mereka duduk.[4][5][6][7][8][9][10] Senator Scott Ludlam dan Larissa Waters, , Timbalan Pemimpin Parti Hijau Australia, secara sukarela meletak jawatan mereka. Satu sesi pendengaran telah dilakukan di Mahkamah Tinggi pada 24 Ogos bagi kes Joyce, Canavan, Roberts, Ludlam dan Waters. Kerajaan memohon agar kes-kes ini didengar oleh Mahkamah Penuh pada awal September,[17][18] namun Mahkamah menjadualkan mereka untuk didengar selama tiga hari bermula 10 Oktober.[19][20] Ketua Hakim Susan Kiefel menyimpulkan sesi pendengaran tersebut: "It is hardly necessary to say that the Court is aware of the need to give its answers to these references with or without reasons as soon as possible. As counsel and instructing solicitors would appreciate, it is not always possible for the Court to do so immediately."[21] Keputusan Mahkamah sudah dijangka.[22]
