Perceraian dalam Islam

Di dalam Islam, penceraian merupakan sesuatu yang tidak disukai oleh Islam tetapi dibolehkan dengan alasan dan sebab-sebab tertentu. Penceraian boleh dilakukan dengan cara talak, fasakh dan khuluk atau tebus talak.

Talak

Talak menurut bahasa bermaksud melepaskan ikatan dan menurut syarak pula, talak membawa maksud melepaskan ikatan perkahwinan dengan lafaz talak dan seumpamanya. Talak merupakan suatu jalan penyelesaian yang terakhir sekiranya suami dan isteri tidak dapat hidup bersama dan mencari kata sepakat untuk mecari kebahagian berumahtangga. Talak merupakan perkara yang dibenci Allah s.w.t tetapi dibenarkan.

Hukum talak

Hukum	Penjelasan
Wajib	a) Jika perbalahan suami isteri tidak dapat didamaikan lagi b) Dua orang wakil daripada pihak suami dan isteri gagal mencapai kata sepakat untuk perdamaian rumahtangga mereka c) Apabila pihak kadi berpendapat bahawa talak adalah lebih baik d) Jika tidak diceraikan keadaan sedemikian, maka berdosalah suami Jika kedua belah pihak dari pihak suami & isteri (ibu, bapa, mertua, ipar dan lain-lain) bersetuju dengan kata sepakat selepas datangnya keyakinan dari Allah SWT di antara kedua belah pihak selepas berusaha dalam perbincangan meneguhkan masjid-masjid Allah SWT (nikah kerana Allah SWT) selepas menjadi wakil pendamai bagi kedua-dua pasangan (selepas solat sunat istikharah) maka reda seorang suami atau bakal bekas suami harus mempunyai keyakinan untuk melafazkan talaknya kerana Allah SWT dalam keadaan tenang dan waras tanpa dipengaruhi oleh mana-mana ketidakbaikan yang berbaur hasutan yang terhasil dari sifat-sifat mazmumah (sifat tercela) atau menzahirkan kebaikan sebelum, semasa dan selepas tutur lafaz dari sifat-sifat mahmudah yakni tanpa rasa amarah dengan keputusan atau lafaz yang akan dizahirkan dgn pemahaman mengikut hukum syarak (agama Islam) iaitu dengan rekod kaunseling secara berperingkat dari pejabat agama Islam daerah, negeri atau negara dalam keadaan berpuashati dengan kenyataan berserta keyakinan bahawasanya jodoh, pertemuan, ajal, maut, rezeki dan lain-lain adalah ketentuan Allah SWT bukan dari makhluk Allah atau hamba Allah SWT semata.
Haram	a) Menceraikan isteri ketika sedang haid atau nifas b) Ketika isteri dalam keadaan suci yang telah disetubuhi c) Ketika suami sedang sakit yang bertujuan menghalang isterinya daripada menuntut harta pusakanya d) Menceraikan isterinya dengan talak tiga sekali gus atau talak satu tetapi disebut berulang kali sehingga cukup tiga kali atau lebih
Sunat	a) Suami tidak mampu menanggung nafkah isterinya b) Isterinya tidak menjaga maruah dirinya
Makruh	Suami menjatuhkan talak kepada isterinya yang baik, berakhlak mulia dan mempunyai pengetahuan agama
Harus	Suami yang lemah keinginan nafsunya atau isterinya belum datang haid (belum baligh) atau telah putus haidnya (menopaus)

Contoh lafaz talak

• Talak sarih

Lafaz yang jelas dengan bahasa yang berterus-terang seperti “Saya talak awak” atau “Saya ceraikan awak” atau “Saya lepaskan awak daripada menjadi isteri saya” dan sebagainya.

• Talak kinayah

Lafaz yang digunakan secara sindiran oleh suami seperti “Pergilah awak ke rumah mak awak” atau “Pergilah awak dari sini” atau “Saya benci melihat muka awak” dan sebagainya. Namun, lafaz kinayah memerlukan niat suaminya iaitu jika berniat talak, maka jatuhlah talak tetapi jika tidak berniat talak, maka tidak berlaku talak.

Jenis talak

Talak raj’i

Suami melafazkan talak satu atau talak dua kepada isterinya. Suami boleh merujuk kembali isterinya ketika masih dalam idah. Jika tempoh idah telah tamat, maka suami tidak dibenarkan merujuk melainkan dengan akad nikah baru.

Talak bain

Suami melafazkan talak tiga atau melafazkan talak yang ketiga kepada isterinya. Isterinya tidak boleh dirujuk kembali. Si suami hanya boleh merujuk setelah isterinya berkahwin lelaki lain, suami barunya menyetubuhinya, setelah diceraikan suami barunya dan telah habis idah dengan suami barunya.

Talak sunni

Suami melafazkan talak kepada isterinya yang masih suci dan tidak disetubuhinya ketika dalam tempoh suci

Talak bid’i

Suami melafazkan talak kepada isterinya ketika dalam haid atau ketika suci yang disetubuhinya.

Talak taklik

Talak taklik ialah suami menceraikan isterinya bersyarat dengan sesuatu sebab atau syarat. Apabila syarat atau sebab itu dilakukan atau berlaku, maka terjadilah penceraian atau talak.

Contohnya suami berkata kepada isteri, “Jika awak keluar rumah tanpa izin saya, maka jatuhlah talak satu.” Apabila isterinya keluar dari rumah tanpa izin suaminya, maka jatuhlah talak satu secara automatik.

Ia juga boleh berlaku selepas akad nikah (ia dipraktikkan di Malaysia dan wajib oleh semua pengantin lelaki untuk melafaznya), berkata, “Jika saya menyeksa isteri saya dengan sengaja, atau saya meninggalkan isteri saya selama empat bulan berterusan dengan sengaja tanpa kerelaannya, dan jika ia mengadu kepada kadi atau naib kadi, apabila disabitkan oleh kadi atau naib kadi maka jatuhlah talak satu ke atas isteri saya.”

Menurut Akta Undang-Undang Keluarga Islam (Wilayah-Wilayah Persekutuan) 1984 Malaysia, Cerai taklik (seksyen 50)

Taklik adalah perjanjian yang ditandatangani semasa pernikahan. Ia membenarkan siisteri memohon perceraian sekiranya sisuami melanggar mana-mana syarat yang terdapat dalam taklik tersebut, misalnya, jika dia tidak membayar nafkah, atau sisuami menyebabkan kemudaratan dengan mencederakan isteri. Mahkamah akan membuat siasatan akan kesahihan kenyataan dan sekiranya berpuas hati mahkamah akan mengesahkan dan merekodkan perceraian tersebut. Bukti seperti laporan polis dan laporan hospital boleh membantu dalam hal ini

Contoh taklik berlaku dengan cara, “Jika saya menyeksa isteri saya dengan sengaja, atau saya meninggalkannya selama empat bulan berterusan tanpa kerelaannya, dan jika ia mengadu kepada kadi atau naib kadi serta membayar RM 1.00 sebagai tebus talak, apabila disabitkan oleh kadi atau naib kadi maka jatuhlah talak satu ke atas isteri saya dengan nilai tebus talak tersebut.”

Fasakh

Erti fasakh menurut bahasa ialah rosak atau putus. Manakala menurut syarak pula, pembatalan nikah disebabkan oleh sesuatu sifat yang dibenarkan syarak, misalnya, perkahwinan suami isteri yang difasakhkan oleh kadi disebabkan oleh suaminya tidak mempu memberi nafkah kepada isterinya. Fasakh tidak boleh mengurangkan bilangan talaknya.

Fasakh hanya boleh dituntut oleh isteri sekiranya terdapat beberapa sebab atau kecacatan yang terdapat pada pihak suaminya. Mengikut mazhab Shafie, seorang isteri boleh menuntut fasakh melalui kadi atau mahkamah disebabkan oleh kekurangan suaminya seperti gila (berkekalan atau sekejab); penyakit kusta; penyakit sopak; penyakit yang menghalang mereka daripada melakukan persetubuhan; suami tidak mampu memberi nafkah belanja kepada isterinya seperti makan dan minum serta tempat tinggal, pakaian, memberi mahar dengan cara tunai sebelum bersetubuh kerana kepapaan atau muflis atau sebagainya; suami tidak bertanggungjawab dengan meninggalkan isterinya terlalu lama dan tidak memberi khabar berita; suami yang menzalimi dan memudaratkan isterinya; suami yang fasik serta melakukan maksiat terhadap Allah dan tidak menunaikan kewajipan kepada Allah; dan murtad salah seorang (suami atau isteri).

Cara melakukan fasakh

• Jika suami atau isteri mempunyai sebab yang megharuskan fasakh
• Membuat aduan kepada pihak kadi supaya membatalkan perkahwinan mereka
• Jika dapat dibuktikan pengaduan yang diberikan adalah betul, pihak kadi boleh mengambil tindakan membatalkannya
• Pembatalan perkahwinan dengan cara fasakh tidak boleh dirujuk kembali melainkan dengan akad nikah yang baru.

DI Malaysia, ia jatuh di bawah Akta Undang-Undang Keluarga Islam (Wilayah-Wilayah Persekutuan) 1984. Cerai fasakh (seksyen 52)

Cerai fasakh adalah cara membubarkan perkahwinan berdasarkan sebab-sebab tertentu. Menurut seksyen 52 (1), terdapat 12 sebab membolehkan membuat permohonan fasakh.

Antara sebabnya ialah :-

1. tempat suami berada tidak diketahui selama lebih daripada satu tahun;
2. suami tidak mengadakan peruntukan bagi nafkah selama tiga bulan;
3. suami dihukum penjara selama tiga tahun atau lebih;
4. suami tidak menunaikan kewajipan perkahwinannya (nafkah batin) tanpa sebab yang munasabah selama tempoh satu tahun.
5. suami mati pucuk masa berkahwin hingga sekarang dan ini tidak diketahui puan;
6. suami telah gila selama dua tahun atau sedang mengidap penyakit kusta, vitiligo atau penyakit kelamin yang boleh berjangkit;
7. jika perempuan dikahwinkan oleh wali mujbir perempuan sebelum baligh, perempuan masih belum disetubuhi suami dan masih belum mencapai umur 18 tahun, kini menolak perkahwinan itu.

Bagaimanapun permohonan cerai fasakh tertakluk oleh mahkamah dan mahkamah berhak menolak sekiranya mendapati bahawa kesahihan alasan tersebut tidak terbukti.

Khuluk atau tebus talak

Perpisahan antara suami dan isteri melalui tebus talak sama ada dengan menggunakan lafaz talak atau khuluk. Pihak isteri boleh melepaskan dirinya daripada ikatan perkahwinan mereka jika ia tidak berpuas hati atau lain-lain sebab. Pihak isteri hendaklah membayar sejumlah wang atau harta yang dipersetujui bersama dengan suaminya, maka suaminya hendaklah menceraikan isterinya dngan jumlah atau harta yang ditentukan.

Hukum khuluk adalah berdasarkan surah al-Baqarah ayat 229 : “Tidak halal bagi kamu mengambil apa-apa yang telah kamu berikan kepada mereka suatu jua pun, kecuali jika takut kedua-duanya tidak akan mengikut peraturan Allah s.w.t.. Jika kamu takut bahawa tidak akan mengikut peraturan Allah maka tiadalah berdosa kedua-duanya tentang barang yang jadi tebus oleh perempuan.”

Ia biasanya dilakukan di depan hakim mahkamah syariah. Talak boleh jatuh dengan menyebut “Saya menceraikan kamu dengan bayaran RM 10,000,” dan isterinya menjawab, “Saya menerimanya.” Apabila suami melafazkan demikian, dan isterinya menyahut tawaran itu, dengan serta-merta jatuhlah talak dengan khuluk dan isterinya wajiblah beridah. Suami isteri hanya boleh merujuk dengan akad nikah baru sahaja.
